Fair Use Guidelines for Educators/Revised 1987

Under the “Fair Use” guidelines, you may copy a portion of a copyrighted work without copyright infringement only if all the guidelines below are met. If the guidelines are not met, copy right permission should be sought.

There are some restrictions regarding producing multiple copies for classroom use.

Copying shall not:

  • be repeated with respect to the same item by same instructor from term to term.
  • be used to create or to replace anthologies, compilations, or collective works.
  • substitute for the purchase of books, publishers reprints or periodicals.
  • be directed by a higher authority (i.e. copying must be at the inspiration anddirections of the individual instructor).
  • be of or from works intended to be “consumable” in the course of teaching. These include workbooks, exercises, standardized test booklets and answer
    sheets.

The following limitations on the portion of the copyrighted work must be applied.

  • Poetry - (a) a complete poem if it is less than 250 words and if it is printed on not more than two pages or, (b) from a longer poem, you may make on excerpt of not more than 250 words.
  • Prose - (a) either a complete article, story, or essay is allowed if it is less than 2,500 words or (b) an excerpt from any prose work of not more than 1,000 words or 10% of the work.
  • illustrations - one chart, diagram, drawing graph, cartoon, or picture per book or periodical issue.
  • Special works - works that combine text with illustrations such as children's
books or poetry. No more than 10% of the words in the text may be used
    without permission.

Permission may not be required if the work is used only once and “the inspiration and decision to use the work and the moment of its use for maximum effectiveness are so close in time that it would be unreasonable to expect a timely reply to a request for permission."

Guidelines for Education or Classroom Copying of Books or Periodicals

Single Copying

Instructors may make single copies of a chapter of a book; an article from a periodical or newspaper; a short story, essay, or a poem; a chart, graph, diagram, drawing, cartoon, or picture from a book, periodical, or newspaper to teach a class.

Multiple Copying

Multiple copies (one copy per pupil in a course) can be made meeting the criteria of brevity, spontaneity, and cumulative effect and if each copy contains a notice of copyright.

1. Brevity.A complete poem printed on no more than two pages or an excerpt from a longer poem not to exceed 250 words copied in either case. A complete article, story, or essay of less than 2,500 words, or from other longer pieces of prose, an excerpt of less than 1,000 words or 10% of the work, whichever is less, but in either event a minimum of 500 words to be copied. Multiple copies can be made of excerpts of fewer than 500 words. One chart, graph, diagram, drawing, cartoon, or picture per book or periodical issue.

2. Spontaneity.Copying is done by the instructor when there is not a reasonable length of time to request and receive permission to copy.

3. Cumulative Effect. The copying is only for one course and only nine instances of multiple copying per course during one class term is allowed. Not more than one short poem, article, story, essay, or two excerpts may be copied from the same author, nor more than three from the same collective work or periodical volume during one class term.
